Sale of customary land illegal – ZLA

• Customary land must not be sold by anyone including the chiefs.
• Chiefs have the right to allocate land to members of the community to use but not to sell it.
• It is illegal to sell customary land as it is not state land.

Zambia Land Alliance says customary land must not be sold by anyone including the chiefs as it is communal land.

Speaking in an interview with Money FM News, Alliance Executive Director Patrick Musole said according to the law, chiefs have the right to allocate land to members of the community to use but not to sell it.

Mr. Musole noted that it is illegal for any individual to sell customary land as it is not state land.

“Traditional leaders look after customary land on behalf of the community, he/she has the right to allocate a piece of land to people to use for agriculture among other projects but not to sell it,” he said.

He stated that members of the community must know that after using customary land, they must leave it for someone else for farming and other projects.

Mr. Musole has since called on people selling and buying customary land to desist.
He said members of the public must buy state land to be at a safer side than state land.
