ACC denies misappropriating forfeited K65 million

• At page 61 of the purported management letter, there is an allegation that K65 million forfeited from Faith Musonda was misappropriated.
• This is a blatant falsehood.
• The money moved from the ACC account at Bank of Zambia to Ministry of Finance on 3rd of March 2022.

Anti-Corruption Commission (ACC) has refuted media reports that it has misappropriated the K65 million recently recovered from Lusaka businesswoman Faith Musonda reasonably suspected to be proceeds of crime.
Addressing Journalists at a media briefing, Commission Board Chairperson Musa Mwenye stated that ACC has not received the information contained in a purported management letter to the institution which is circulating on social media and reported in one of the daily tabloids today.
Mr. Mwenye explained that the K65 million moved from the Commission’s account at Bank of Zambia and handed over to Ministry of Finance on 3rd March, 2022.
“We will not address the document that is circulating on social media but suffice to say that it contains a lot of inaccuracies and details that appear tailored to deliberately embarrass the institution. For example, at page 61 of the purported management letter, there is an allegation that K65 million forfeited from Ms. Faith Musonda was misappropriated.”
“This is a blatant falsehood. All of you members of the press attended a media briefing on the 23rd February 2022 at which the Anti-Corruption commission handed over a cheque for K65, 333,046 to the Minister of finance. The money moved from the Anti-Corruption Commission account at Bank of Zambia to the Ministry of Finance on 3rd of March 2022. It is therefore not true that this money was misappropriated in the ACC,” Mr. Mwenye stated.
He added that it is ACC’s hope that the purported management letter has not been leaked from the Auditor General’s office before being availed to the Commission first.
“We have not received the document that is circulating on social media and have only had sight of it from social media and press reports. We are therefore not aware of its authenticity. This having been said, we hope that this letter has not been leaked from the Auditor General’s office without it being availed to us first. The history of this matter and the surrounding circumstances raise great cause for concern.”
“The investigation at Ministry of Finance started in November 2020, long before this board was appointed. Following investigations, the two deputy auditor generals and the auditor general were arrested on 1st March 2023, 2nd March 2023 and 9th March 2023 respectively. The Auditor General was interviewed on the 10th of February 2023. On the 3rd of March 2023, we received a formal request for information from the auditor general’s office in furtherance of an audit. The audit was therefore only initiated after the interrogation and later arrest of the top officials in the Auditor General’s office.”
Meanwhile, Mr. Mwenye called on the media to avoid publishing alarming statements without verifying the facts with relevant institutions.
“We are at pains to see why colleagues in the press, would publish unconfirmed documents when you attended the handover of the money from the Anti-Corruption Commission. No attempt was made to verify any of this information with ACC, Bank of Zambia or Ministry of Finance.”
“You members of the press are key Partners in the fight against corruption and in future, we would urge you to avoid publishing alarming statements without verifying the same. I wish to reiterate that the Anti-Corruption Commission, like any other government institution is open to accountability and where warranted criticism but such criticism must be based on fact and not innuendo,” he said.
According to a leaked Auditor General’s Management Letter to the Commission for the financial year ended December 31, 2022, Faith Musonda’s forfeited cash amounting to K65 million and US$57, 950,000 have not been deposited into control 99 and that the whereabouts of the funds are still unknown.
