• The decision is pursuant to section 96 of the Public Procurement Act.
• All procuring entities must enforce the suspension by not awarding contracts to the firm.
• Procuring entities must not enter into any new contracts with the company after 20th December, 2021.
Zambia Public Procurement Authority (ZPPA) has with immediate effect suspended Vglux Resources Corporation Limited from participating in public procurement in the country for one year for breaching procurement laws and procedures.
In a statement, Authority Public Relations Officer Nchimunya Muganya said the decision to suspend the said company is pursuant to section 96 of the Public Procurement Act Number 8 of 2020 and Regulation 167 of the Public Procurement Regulations, 2011.
Ms. Muganya advised all procuring entities to enforce the suspension by ensuring that they do not award contracts to the firm, sale or issue solicitation documents or in any other way invite bids from the company, and enter into any other dealings or communications except in respect of existing contracts signed before the suspension.
“In exercise of the powers vested in the Authority under section 96 of the Public Procurement Act No. 8 of 2020 and Regulation 167 of the Public Procurement Regulations, 2011, be advised that Vglux Resources Corporation Limited of Lusaka has been suspended from participating in public procurement in Zambia for a period of one year with effect from 20th December, 2021.”
“The suspension includes any successor in interest including any entity which employs, or is associated with Vglux Resources Corporation Limited,” Ms. Nchimunya said.
She however stated that the suspension does not limit the firm from performing outstanding contracts that were entered into before the date of the suspension.
Ms. Nchimunya further advised procuring entities not to enter into any new contracts with the company after 20th December, 2021 and during the period that the suspension will be in force.
“ZPPA is therefore, notifying procuring entities not to engage in any procurement process with the named company. To this effect, ZPPA has issued circular No.8 of 2021 to all Permanent Secretaries and Controlling Officers, Chief Executive Officers of parastatals and statutory bodies, all Town Clerks and Council Secretaries of local authorities,” she added.
